1. The Service

ApexVPS provides virtual private servers ("VPS") with the resources described on the pricing page. By placing an order you agree to these terms. Server access details are delivered to the email address provided at checkout after payment is confirmed.

2. Payments

Plans are priced in USD and paid in cryptocurrency through our payment processor, OxaPay. The crypto amount is fixed when the invoice is created and the invoice remains valid for 90 minutes. An order is confirmed only after the transaction is validated on-chain. Underpaid or late transactions may require support intervention.

3. Refunds — 30-day money-back guarantee

You may request a full refund within 30 days of your first payment for a plan, provided your usage complied with the acceptable use policy below. Refunds are issued in USDT to a wallet address you provide. Renewal payments and usage beyond the first 30 days are non-refundable except where required by law.

4. Acceptable Use

You may not use the service for: illegal activity of any kind; sending spam; hosting malware, phishing or botnet infrastructure; launching denial-of-service attacks or network scans against third parties; or activity that harms the integrity of our network. We may suspend or terminate servers involved in such activity without refund.

5. Service Levels

Uptime targets and credits are described per-plan on the pricing page. SLA credits are applied to future service and are your exclusive remedy for downtime. Scheduled maintenance announced in advance is excluded from SLA calculations.

6. Your Data & Backups

You are responsible for your server's content and for keeping independent backups of critical data. Where a plan includes backups, they are provided on a best-effort basis and are not a substitute for your own backup strategy.

7. Termination

Service continues for the period paid. If a renewal payment is not received by the due date, the server may be suspended and, after 7 days, permanently deleted along with its data.

8. Liability

The service is provided "as is". To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the service in the 3 months preceding the claim. We are not liable for indirect or consequential damages, including lost profits or lost data.

9. Changes

We may update these terms; material changes will be announced on this page with an updated date. Continued use of the service after a change constitutes acceptance.
